Plain-language summary

Clubium helps people discover local businesses and gives businesses tools to publish information, receive enquiries or bookings, manage a Business Page and use growth features. Clubium generally provides the technology and directory—not the underlying local service. You must use the platform honestly, pay applicable charges, respect other users and follow the law.

01

Acceptance of these terms

These Terms and Conditions form a binding agreement between you and Clubium. They apply whenever you access or use a Clubium website, account, directory page, Business Page, business workspace, form, booking feature, referral feature, subscription or other service that links to these terms.

By accessing or using Clubium, creating an account, claiming or adding a business, purchasing a plan, or submitting content, you confirm that you have read and agree to these terms and the policies referenced in them. If you do not agree, do not use the platform.

Additional terms may apply to a specific paid service, promotion, integration or feature. If additional terms conflict with these general terms, the feature-specific terms control for that feature.
02

Eligibility, authority and accounts

You must be legally capable of entering into a binding agreement in the place where you live. Business-owner accounts, paid subscriptions and business-management tools are intended for adults and authorized business representatives.

  • Provide complete, current and accurate registration, billing and business information.
  • Use your own identity or act with valid authority for the business or organization you represent.
  • Keep passwords, verification codes and authentication methods confidential.
  • Promptly notify Clubium if you suspect unauthorized access or misuse.
  • Do not sell, transfer, share or create accounts to evade restrictions unless Clubium expressly permits it.

You are responsible for activity performed through your account unless caused by Clubium failing to use reasonable security safeguards.

03

What Clubium provides

Business discovery

Search, categories, cities, maps, filters, business profiles and local discovery tools.

Business Pages

Public pages, business information, media, contact methods, offers, FAQs and related content.

Business tools

Listing management, bookings, leads, analytics, domains, integrations and workspace settings.

Growth services

Optional advertising setup, campaign support and other services described in the selected plan.

Unless Clubium expressly states otherwise, local businesses listed on the platform are independent from Clubium. Clubium does not own, operate, employ, endorse or control them and is not a party to agreements between customers and businesses.

04

Directory listings and public information

Clubium may create, display, organize, update, merge, rank, randomize, promote, deactivate or remove business listings using information supplied by businesses, users, public sources, data providers or legacy directory records.

  • An unclaimed listing does not mean that the business has created, verified or endorsed the listing.
  • Claimed, verified, featured or promoted labels describe a platform status and are not a guarantee of quality, legality, availability or performance.
  • Search order and visibility may depend on relevance, location, category, completeness, activity, promotion, randomization and other platform factors.
  • Business hours, prices, availability, photos, descriptions and contact details can change and should be confirmed directly with the business.

Clubium may correct obvious errors and may request supporting information before changing ownership, identity or material listing details.

05

Business owners, claims and Business Pages

When you claim, add or manage a business, you represent that you are the owner or have authority to act for the business. Clubium may require email, phone, document, domain, location or other verification and may approve, reject or revoke a claim.

Business users are responsible for:

  • Keeping names, licences, addresses, contacts, prices, policies, availability, images and service information accurate.
  • Obtaining rights and permissions for logos, photographs, videos, trademarks and other uploaded material.
  • Responding lawfully and professionally to enquiries, bookings, reviews and customer information.
  • Maintaining required registrations, permits, insurance, tax treatment and industry compliance.
  • Managing workspace access and removing former staff or unauthorized users.

Clubium may preserve basic public directory information after a business account closes or a claim ends, subject to applicable law and listing-policy requirements.

06

Plans, trials and subscriptions

Clubium may offer free, trial and paid plans. The price, billing cycle, included features, usage limits, advertising services, domain options and any trial period are shown on the pricing page, order screen or account interface at the time of purchase.

  • Trials may convert to a paid plan only where the order flow clearly states this and a valid payment method has been provided.
  • Paid subscriptions renew automatically for the displayed billing period unless cancelled before the renewal date.
  • Features, limits and availability may differ by plan and may be updated as permitted by these terms.
  • Unused features, advertising allocations or service time do not carry forward unless Clubium expressly states otherwise.
  • Custom-domain use remains subject to domain ownership, DNS configuration, third-party registrar rules and technical compatibility.

Clubium may change future prices by giving reasonable notice. A price change applies from the next renewal or the date stated in the notice, not retroactively to a completed billing period.

07

Payments, taxes, cancellation and refunds

You authorize Clubium and its payment providers to charge the displayed amount, applicable taxes and any approved recurring fees using the payment method selected at checkout. You must keep billing information current and are responsible for bank, card, currency-conversion or third-party charges.

ItemGeneral ruleImportant note
Subscription cancellationYou may cancel through available account controls or by contacting Clubium.Access normally continues until the end of the paid billing period unless stated otherwise.
RefundsFees are generally non-refundable once a billing period or delivered service has started.Mandatory consumer rights and any written refund promise still apply.
Failed paymentsClubium may retry payment, limit paid features or suspend the subscription. You remain responsible for valid outstanding charges.
Advertising servicesMedia spend and third-party advertising charges may be separate from Clubium service fees.Advertising performance, approvals and results are not guaranteed.

If a payment is disputed or reversed without a valid basis, Clubium may suspend the related account while the matter is reviewed.

08

Bookings, enquiries, leads and customer transactions

Clubium may allow customers to send an enquiry, request a booking, call, message, visit a website or otherwise contact a listed business. Unless the checkout or booking screen expressly identifies Clubium as the seller, the business—not Clubium—is responsible for confirming, pricing, delivering, changing, cancelling or refunding the local service.

  • A submitted request is not necessarily an accepted booking.
  • Customers must provide accurate contact and service-request information.
  • Businesses must use lead and booking information only for legitimate service, support and legally permitted communication.
  • Customers and businesses should confirm price, taxes, deposits, cancellation rules, timing, accessibility, safety and service scope directly.
  • Disputes about the underlying service should first be addressed between the customer and business.

Clubium may assist with platform-related issues but is not required to mediate or resolve every customer-business dispute.

09

Acceptable use

You must not use Clubium to:

  • Break the law, violate another person’s rights or facilitate fraud, deception, harassment or discrimination.
  • Publish false, misleading, impersonating, defamatory, obscene, dangerous or unlawful content.
  • Create fake listings, fake reviews, fake bookings, artificial engagement or misleading ownership claims.
  • Scrape, copy, harvest or extract platform data at scale without written permission.
  • Interfere with security, access controls, rate limits, software, infrastructure or another user’s account.
  • Upload malware, harmful code or material designed to disrupt or monitor others without authorization.
  • Use customer or business information for spam, unauthorized marketing, resale or unrelated profiling.
  • Reverse engineer, resell or commercially exploit the platform except through an authorized agreement.

Clubium may investigate suspected misuse and cooperate with lawful requests from regulators, courts or law-enforcement authorities.

10

User content, reviews and feedback

You retain ownership of content you submit, but you grant Clubium a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting, display, distribute and use that content as reasonably necessary to operate, improve, secure and promote the platform and the relevant business listing.

You represent that you have the rights needed to submit the content and that it is accurate, lawful and not confidential unless the feature is designed for private submission. Clubium may moderate, edit formatting, restrict visibility or remove content that violates these terms, creates risk or reduces directory quality.

Reviews and ratings

Reviews should reflect genuine experiences and must not be purchased, exchanged, manipulated or posted by undisclosed interested parties. Clubium may use automated and manual methods to detect suspicious activity but does not guarantee that every review is accurate.

Ideas and feedback

Suggestions may be used by Clubium without restriction or compensation, provided we do not publicly identify you without permission.

11

Clubium intellectual property

The Clubium platform, software, design, databases, branding, logos, interfaces, documentation and original content are owned by or licensed to Clubium and are protected by intellectual-property laws.

Subject to these terms, Clubium grants you a limited, revocable, non-exclusive and non-transferable right to use the platform for its intended purpose. No ownership rights are transferred. You may not copy, modify, sell, sublicense, create derivative products from or remove proprietary notices from Clubium materials except where the law permits or Clubium gives written permission.

Third-party business names, logos and content belong to their respective owners and their appearance on Clubium does not imply endorsement.

12

Third-party websites, providers and integrations

Clubium may link to or integrate with payment processors, maps, analytics tools, advertising platforms, messaging services, booking providers, domain registrars, social networks and other third parties. Their services are governed by their own terms, privacy practices, availability and fees.

Clubium is not responsible for third-party content, outages, security, approvals, account actions or changes. You are responsible for reviewing third-party terms and configuring integrations, permissions and credentials safely.

Connecting an external account authorizes Clubium to exchange the information reasonably required for that integration until access is removed, expires or is revoked.
13

Suspension, termination and account closure

You may stop using Clubium at any time and may close an account through available controls or by contacting us. Closing an account does not automatically remove public business information that Clubium may lawfully maintain as part of the directory.

Clubium may limit, suspend or terminate access, remove content, revoke a business claim or disable features when reasonably necessary to:

  • Address a violation of these terms or another published policy.
  • Protect users, businesses, Clubium or third parties from security, legal or reputational risk.
  • Respond to non-payment, chargebacks, fraud or unauthorized access.
  • Comply with law, court orders or regulatory requirements.
  • Discontinue a feature, plan or the platform.

Where practical, Clubium may provide notice and an opportunity to correct the issue. Serious or urgent matters may require immediate action.

14

Disclaimers

Clubium is provided on an “as is” and “as available” basis to the maximum extent permitted by law. Clubium does not guarantee uninterrupted access, error-free operation, permanent storage, search position, customer enquiries, bookings, advertising approval, campaign performance, revenue, business results or the accuracy of every third-party listing.

Business information and user content may contain errors or become outdated. Customers should independently assess a business and confirm material details before purchasing, visiting, booking or sharing sensitive information.

Nothing in these terms excludes warranties, guarantees or rights that cannot legally be excluded.

15

Limitation of liability

To the maximum extent permitted by law, Clubium and its directors, officers, employees, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profits, revenue, data, goodwill, opportunities or business interruption arising from use of the platform or dealings with a listed business.

To the maximum extent permitted by law, Clubium’s total aggregate liability arising from the platform or these terms will not exceed the greater of:

  • the amount you paid directly to Clubium for the affected service during the six months before the event giving rise to the claim; or
  • USD 100 if you did not pay Clubium for the affected service.

These limitations do not apply where liability cannot be limited by law, including liability resulting from fraud, wilful misconduct or other legally non-excludable conduct.

16

Indemnity

If you use Clubium for a business or organization, you agree to defend, indemnify and hold harmless Clubium and its directors, officers, employees, contractors and affiliates from third-party claims, losses, damages, liabilities and reasonable costs arising from:

  • your business, services, transactions, listings or customer interactions;
  • content you submit or instructions you give;
  • your violation of these terms, applicable law or another person’s rights; or
  • unauthorized or unsafe use of your account, workspace or integrations.

This obligation applies only to the extent permitted by law and does not cover loss caused by Clubium’s own unlawful conduct.

17

Governing law and disputes

These terms are governed by the laws applicable to the legal entity and jurisdiction configured for this platform, together with any mandatory consumer or other laws that apply to the user or transaction.

Before starting formal proceedings, you and Clubium agree to make a reasonable effort to resolve the dispute by written notice describing the issue and requested resolution. Unless mandatory law requires otherwise, disputes will be handled by the competent courts or tribunals of the applicable jurisdiction.

Nothing in this section prevents either party from seeking urgent injunctive relief or using a legally available small-claims process.

18

Changes, general terms and contact

Changes to the terms

Clubium may update these terms when services, pricing models, laws, risks or business practices change. The effective date at the top shows when the current version applies. Material changes may also be announced through the website, account interface or email. Continued use after the effective date means you accept the updated terms.

General provisions

  • If part of these terms is unenforceable, the remaining terms continue to apply.
  • Failure to enforce a term immediately is not a waiver of that term.
  • You may not assign these terms without Clubium’s written permission. Clubium may assign them as part of a corporate reorganization, financing, merger, acquisition or sale.
  • These terms, the Privacy Policy and any applicable feature-specific terms form the entire agreement for use of the platform.
  • Headings and plain-language summaries are for convenience and do not limit the legal meaning.
